Embezzlement California Penal Code 503

California Penal Code Section 503 defines Embezzlement as follows: Embezzlement is the fraudulent appropriation of property by a person to whom it has been intrusted. Embezzlement is a type of larceny that did not originally exist at common law because it did not involve a tresspassory taking.

However, a standard common law definition would be the (1) fraudulent (2) appropriation (3) of property (4) of another (5) by a person in lawful possession of said property. California statutory law is similar to this definition.
